Eligibility & Approval
Community Partners may be non-REALTOR® professionals in real-estate related fields, such as students, appraisers, mortgage brokers, inspectors, housing advocates and technology vendors.
To be eligible, applicants must:
- Be legally authorized to operate in Ontario;
- Hold all required licences, registrations, or certifications for their profession – all in good standing; and
- Not be registered to trade in real estate.
OREB reserves the right to verify the applicant’s standing with the applicable regulatory or licensing body.
For approval, applications shall be reviewed and processed by the Chief Executive Officer, who shall assess the applicant’s eligibility.
- The Chief Executive Officer will notify the applicant of the status of the application as soon as practicable after it has been processed.
- If the application is not approved, the Chief Executive Officer shall provide the applicant with a written decision setting out reasons for the decision.
Fees & Payment
The Community Partner shall pay a monthly fee of $100.00 plus HST. Once the application has been approved and processed, an online invoice will be sent to the Applicant for payment. Access will not be provided until the invoice has been paid and automatic monthly payments have been set up.
OREB reserves the right to change fees with thirty (30) days written notice to the Community Partner.
Conditions
- All Community Partner applications are subject to review and approval by OREB;
- Community Partners do not hold membership in OREB and, as such, are not entitled to hold office, to vote or to attend business meetings;
- Community Partners will not receive any MLS® services or services provided by CREA or OREA;
- Community Partners are not entitled to exclusivity for their business type/service; and
- OREB reserves the right to terminate all rights and privileges of a Community Partner for cause, without recourse of appeal, or to terminate the program at any time.
Termination
The Community Partner may terminate this Agreement by providing thirty (30) days’ written notice to OREB.
OREB may suspend or terminate this Agreement immediately and without notice:
- If the Community Partner’s account is in arrears for more than thirty (30) days;
- If OREB believes, in its sole discretion, that the Community Partner has breached any term or condition of this Agreement;
- If the Community Partner or any of its employees becomes registered to trade in real estate;
- If the Community Partner ceases to hold all required licences, registrations, or certifications for its profession;
- If, in the sole discretion of OREB, the Community Partner’s continued participation would interfere with the operation of OREB or any of its members, or would be detrimental to the integrity, reputation, or objectives of OREB; or
- If OREB decides to discontinue the Community Partners program, upon thirty (30) days’ written notice.
Upon termination of this Agreement for any reason:
- All outstanding fees shall become immediately due and payable;
- The Community Partner’s access to all Program Benefits shall cease immediately; and
- The Community Partner shall return or destroy all Confidential Information as directed by OREB.
Declaration
1. Representation & Warranties
1.1
The Community Partner represents and warrants that:
- It is legally authorized to operate in Ontario;
- It holds all required licences, registrations, or certifications for its profession and will maintain such credentials throughout the term of this Agreement;
- Neither the Community Partner nor any of its employees are registered to trade in real estate;
- All information provided in the application is true, accurate, and complete; and
- It has the authority to enter into this Agreement.
1.2
The Community Partner shall immediately notify OREB in writing if any of the representations and warranties cease to be true or accurate.
2. Use of Confidential Information
2.1
The Community Partner shall use the Confidential Information solely for its own internal business purposes and shall not change, alter, or modify in any way whatsoever any information derived from OREB.
2.2
The Community Partner shall not copy, modify, sell, licence, rent, remarket, publish, distribute, disseminate, or in any way commercialize the Confidential Information or any part thereof, except as expressly permitted in this Agreement.
2.3
The Community Partner shall not disclose the Confidential Information to any third party and shall use all reasonable efforts to protect all Confidential Information from unauthorized access, distribution, copying, or use.
2.4
The Community Partner shall establish and maintain effective security procedures to prevent unauthorized access to the Confidential Information.
2.5
The Community Partner shall promptly notify OREB of any accidental or unauthorized access to or disclosure of any Confidential Information.
3. Privacy
3.1
The parties shall comply with all applicable privacy legislation, including the Personal Information Protection and Electronic Documents Act and any successor or similar legislation in the Province of Ontario.
3.2
The Community Partner shall not use any personal information obtained through the Program Benefits for any purpose other than as expressly permitted under this Agreement.
4. Intellectual Property
4.1
The Community Partner acknowledges and agrees that all right, title, and interest, including all copyrights, trademarks, and other proprietary rights, in and to the Confidential Information and all materials provided by OREB are and shall remain the property of OREB or its licensors.
4.2
The Community Partner acknowledges that the CREA Marks are trademarks owned by the Canadian Real Estate Association and used under licence by OREB. Any use or display of the CREA Marks by the Community Partner must comply with CREA’s Rules, Regulations, and Policies.
4.3
The Community Partner shall not, during or after the term of this Agreement, challenge the validity or ownership of the CREA Marks or claim any right to use or register any initials, word, or design that is identical with or similar to the CREA Marks.
5. Warranty Disclaimer
5.1
OREB expressly disclaims any and all warranties with respect to the Program Benefits and the Confidential Information, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, or non-infringement.
5.2
The Community Partner acknowledges that the Confidential Information is provided “as is” and OREB makes no representations or warranties regarding its accuracy, completeness, or reliability.
6. Limitation of Liability and Indemnity
6.1
OREB shall not be responsible for any direct, indirect, special, incidental, or consequential damages or any other obligations or liability arising out of or in any way connected with this Agreement or the use by the Community Partner of the Program Benefits or Confidential Information.
6.2
The Community Partner shall indemnify and hold harmless OREB, its directors, officers, employees, and agents from and against any and all claims, demands, actions, liabilities, damages, costs, and expenses (including reasonable legal fees) arising as a result of or in connection with:
- The Community Partner’s use of the Program Benefits or Confidential Information;
- Any breach by the Community Partner of any term or condition of this Agreement;
- Any misrepresentation by the Community Partner; or
- Any negligent or wrongful act or omission of the Community Partner.
